Refund Policy

1. Right of Withdrawal

 

In accordance with Croatian law and the EU Consumer Protection Directive, buyers of online purchases have the right to withdraw from the purchase contract without giving any reason within 14 days from the date of receiving the goods.

⚠️ This right does not apply to purchases made in person at our physical locations.

2. Return Conditions

​

• Goods must be returned unused, undamaged, and in their original packaging, including all accessories and documentation.

• Products that have been used in water (e.g. eFoil, Jet Board, wakesurf and wakeboard boards, vests, wetsuits, helmets) cannot be returned, as they lose hygiene standards and value.

• If the goods have been used beyond necessary testing, the refund amount may be reasonably reduced.

 

3. Reasons for Return

 

Customers may return goods only for the following reasons:

• Withdrawal from the contract within the 14-day statutory period (applies to online orders only).

• Delivery of damaged, defective, or incorrect goods.

 

4. Return Procedure

2. Provide the order number and reason for return.

3. Ship the goods no later than 14 days from the date of filing your request, to the address provided in Section 7.

 

5. Refunds

​

• After receiving and inspecting the returned goods, a refund will be issued within 14 days using the same payment method as the original transaction, unless expressly agreed otherwise.

• Return shipping costs are borne by the customer, except in cases of defective or incorrect goods.

• ACTION YACHTS d.o.o. may withhold the refund until the goods are received back, or until proof of shipment is provided.

 

6. Exceptions to the Right of Withdrawal

​

(1) If you are a business entity within the meaning of Article 72 of the Consumer Protection Act (“Zakon o zaštiti potrošača”) and you enter into the contract as part of your business or independent professional activity, you do not have the right of withdrawal.

 

(2) The right of withdrawal also does not apply to:

• Goods manufactured or customized according to the customer’s individual requirements (personalized products).

• Goods that have been used for hygienic reasons.

• Services that have been fully performed with the customer’s consent before the expiry of the withdrawal period.

• Goods purchased as part of special discount campaigns or clearance sales (e.g. “special price,” “Black Friday,” “last pieces sale”), if explicitly stated in the product offer.

These Refund & Return Terms are effective from 1 February 2025 and apply to all goods purchased after this date.
