1.1
By purchasing any product or accessory from Action Yachts, the Buyer enters into a contractual relationship with Action Yachts d.o.o. These Terms and Conditions (“Terms”) govern the rights and obligations of the contracting parties.

 

1.2
By placing an order (e.g., by clicking the “buy” button) or paying for goods, the Buyer confirms that they have read and agree with these Terms, including:

• Complaints Policy,

• Privacy Policy,

• Delivery Conditions,

• and related documents (Troubleshooting Guide, Instructions, Maintenance, Safety Measures, Return Policy, Installation Manual, Safety Warnings).

These Terms apply to all goods and accessories offered and sold by Action Yachts, regardless of the place of purchase (internet, showroom, trade fairs, phone, or email orders).

 

2. PURCHASE
2.1. An order becomes binding once confirmed by Action Yachts via email.
2.2. Action Yachts reserves the right to reject or cancel an order in case of pricing errors, product unavailability, or suspected misuse.
2.3. Until full payment is received, goods remain the property of Action Yachts.
2.4. Purchases are permitted only for persons over 18 years of age.

 

3. DELIVERY AND ACCEPTANCE
3.1. Delivery conditions are available at www.waverideclub.com
3.2. The Buyer must inspect goods immediately upon receipt. Any visible damage must be recorded and reported on the same day.
3.3. If the Buyer refuses to accept goods without valid reason, the contract is deemed terminated, and Action Yachts may claim reimbursement of incurred costs.

 

4. WARRANTY AND COMPLAINTS
4.1. All products are covered by the statutory warranty under Croatian Consumer Protection Law and relevant EU directives.
4.2. The standard warranty period is 24 months for consumers (B2C). For businesses (B2B), warranty applies only as defined in the sales contract or invoice.
4.3. Warranty periods for specific eFoil components and accessories are stated in the Complaints Policy.
4.4. Complaints must be submitted in writing, along with proof of purchase (invoice) and the product serial number.
4.5. Action Yachts reserves the right to reject a complaint if:

• the Buyer does not provide proof of purchase,

• the product is damaged due to misuse,

• the warranty period has expired,

• the defect is not manufacturing-related but caused by the user.

 

5. WITHDRAWAL FROM THE CONTRACT
5.1. Consumers (B2C) have the right to withdraw from the contract within 14 days of receiving the goods, in accordance with Croatian Consumer Protection Law.
5.2. Goods must be returned unused, undamaged, and in original packaging. Return costs are borne by the Buyer.
5.3. If goods have been used or damaged, Action Yachts has the right to proportionally reduce the refund.
5.4. Returns are not possible for personalized or custom-made products.
5.5. Consumables (e.g., batteries) can only be returned if unopened in their original packaging.
5.6. Business buyers (B2B) do not have the statutory right of withdrawal, unless Action Yachts agrees to accept a return as a goodwill gesture.

 

6. LIABILITY
6.1. Action Yachts is not liable for:

• damage caused by misuse of the product,

• damage caused by third parties, unauthorized services, or modifications,

• loss of profit or indirect damages due to inability to use the product,

• damages caused by force majeure (fire, flood, earthquake, war, regulation).

6.2. Total liability of Action Yachts is limited to the maximum purchase price of the product.

 

7. PAYMENTS AND PRICES
7.1. All prices are stated in EUR and include VAT.
7.2. Action Yachts reserves the right to change prices at any time without prior notice.
7.3. Refunds are processed using the same payment method wherever possible. For cryptocurrency payments, refunds are made in EUR, with no compensation for exchange rate differences.

 

8. FINAL PROVISIONS
8.1. These Terms are governed by the laws of the Republic of Croatia.
8.2. All disputes shall be settled before the competent court in Zagreb, unless exclusive jurisdiction of another court is mandated by law.
8.3. Contracts are concluded in Croatian. In case of discrepancies between translations, the Croatian version prevails.
